Not legal advice. This page summarises official texts and open data; it does not tell you whether a particular home can be let or keep its registration. Town halls set their own planning rules and communities of owners can restrict tourist use: before you buy, let or advertise, check with the regional tourism department and the Ayuntamiento, or ask a professional.
The rules in the Community of Madrid
Registration number: The 2014 rule that required the register number in every advert (Decreto 79/2014, art. 17.5) was annulled by the Supreme Court in judgment 1741/2018, as the preamble of Decreto 29/2019 states; the new art. 17 does not contain it.
- Owners of tourist homes (or their representatives) must file a declaración responsable with the regional tourism department, together with the CIVUT, the certificate of suitability for tourist use (Decreto 79/2014, art. 17.1 as amended in 2019). (Boletín Oficial de la Comunidad de Madrid)
- After the declaration, registration on the Registro de Empresas Turísticas follows art. 23 of Ley 1/1999 (art. 17.3); that article describes the register as public and registration as voluntary (Ley 1/1999, art. 23.2). (Boletín Oficial del Estado)
- In buildings under horizontal property, tourist use can be limited or conditioned under the Ley de Propiedad Horizontal (art. 17.5 as amended in 2019). (Boletín Oficial de la Comunidad de Madrid)
- The 2016 regional court judgment 302/2016 annulled the 5-day minimum stay of the original decree (preamble of Decreto 29/2019). (Boletín Oficial de la Comunidad de Madrid)
The town hall of Madrid sets its own planning rules for tourist use: ask the Ayuntamiento (urbanismo) before you buy or start letting. Full details: Community of Madrid holiday let licence.
