Not legal advice. This page summarises official texts and open data; it does not tell you whether a particular home can be let or keep its registration. Town halls set their own planning rules and communities of owners can restrict tourist use: before you buy, let or advertise, check with the regional tourism department and the Ayuntamiento, or ask a professional.

15,764 homes on the register against 6,987 counted by INE on the platforms: INE (Spain's national statistics institute) counts tourist homes listed on the three most used accommodation platforms in Spain, by web scraping and removing duplicates; it publishes the count twice a year, with reference dates in May and November. It is a different measure from the regional register, which also includes homes that are not advertised.
The rules in Andalusia
Registration number: Andalusian rules require the home's alphanumeric RTA code on the document given to every guest on arrival (Decreto 28/2016, art. 7.1), and tourism businesses must make their RTA registration details available to guests (Ley 13/2011, art. 26.1 b). The texts we read do not set a separate rule on adverts.
- Before starting, the host files an electronic declaración responsable with the regional tourism department; from that moment the home may be advertised as a vivienda de uso turístico (Decreto 28/2016, art. 9.1). (Junta de Andalucía)
- The declaration states that the home is compatible with local urban planning and has, where required, the licence or declaration for change of use (art. 9.1 e). (Junta de Andalucía)
- It also states that the community of owners does not prohibit tourist use and has expressly authorised it in the terms required by state law (art. 9.1 g). (Junta de Andalucía)
- Town halls may set limits on the maximum number of tourist homes per building, sector, area or zone, for an overriding reason of general interest (art. 2.2). (Junta de Andalucía)
- Only one home per cadastral reference can be registered, except where several homes legally share one (art. 9.1 a). (Junta de Andalucía)
- Registration on the RTA is done on the basis of the declaration, and filing it is enough to start the activity (Ley 13/2011, art. 38.2). (Boletín Oficial del Estado)
The town hall of Marbella sets its own planning rules for tourist use: ask the Ayuntamiento (urbanismo) before you buy or start letting. Full details: Andalusia holiday let licence.
